Arena Usage Release
Twisted M Farm welcomes riders to haul in and use our covered ring! Please contact management to schedule a date/time, fee is $25/horse.
1. RECITAL. I the undersigned Participant, desire to participate in using, riding, exhibiting, or other involvement with horses, and/or in other activities conducted at, with, or from Twisted M Farm LLC, 3633 CR 168, Mckinney, TX 75071. As part of the consideration for such participation, and to induce Twisted M Farm LLC to allow me to participate, I have agreed to this Release of Liability and Hold Harmless Agreement (hereinafter referred to as Agreement). This agreement will apply to my participation in such activities on any date on or after the signature date indicated below, unless and until I give formal written notice to Twisted M Farm LLC that I will no longer be bound by this Agreement. I further understand that any formal withdrawal from the Agreement by me will result in my inability to participate in any activity on, with, or from Twisted M Farm LLC.
2. ACKNOWLEDGMENT OF RISK. I understand that there are substantial risks and dangers inherent in keeping, training, transporting, approaching, being around, and riding horses and related equine activity; these risks and dangers apply to myself and other third parties. I realize that dangers may arise at any time, anticipated or unanticipated, including dangers to my life, the lives of third parties from the unpredictable nature of horses, and other causes such as the acts or omissions of other riders, trainers, employees, the unpredictable nature of horses or other animals, conditions or circumstances on Twisted M Farm LLC grounds. I voluntarily assume all risks and dangers of death, harm, and/or damage to my person or property, resulting from or arising out of conditions at or about Twisted M Farm LLC grounds, the activities carried on here at Twisted M Farm LLC, and the actions of third parties and their animals not controlled by Twisted M Farm LLC. I assume all risks and danger of injury, death, harm, and/or damage to the person or property of Twisted M Farm LLC and/or other third parties caused by my actions. I accept full responsibility for all medical expenses incurred due to any of the foregoing. I further agree to keep my horse(s) and any other animals belonging to me, as well as my children and guests on the Twisted M Farm LLC grounds in control at all times and to act at all times in a reasonable and prudent manner and to not act negligently and acknowledge liability for all of mine and their actions.
3. HELMET WAIVER. I have read and understand the Twisted M Farm LLC Rules and Regulations and I agree to abide by them and to require that my children and guests abide by them at all times. I recognize the Twisted M Farm LLC Rules and Regulations require the use of an ASTM/SEI certified helmet by all riders under the age of eighteen (18). I recognize that wearing an ASTM/SEI certified helmet could prevent permanent brain damage in the case of an accident. If I decline to wear a helmet while on Twisted M Farm LLC grounds, I assume all risks involved in handling and riding horses without wearing a hard hat.
4. RELEASE, HOLD HARMLESS, WAIVER, AND PLEDGE. I further release, discharge, and agree to indemnify and hold harmless Twisted M Farm LLC, its owners, managers, agents, officers, employees, contractors, veterinarians and farriers, and successors of the foregoing, to the fullest extent allowed by law, from any claim, suit, expense or loss which arises out of my participation in activities at the premises of Twisted M Farm LLC, the stabling of horses at Twisted M Farm LLC, my involvement in use care handling, approaching, riding, pasturing, transportation, or exhibiting of any resident or visiting horses including stallions, or the condition of the premises, horses, equipment or tack at Twisted M Farm LLC. I further waive and release subrogation claims of all medical, disability, property, and liability insurers, including, but not limited to damage resulting in medical and convalescent care, and cost of support; and as security for this Release and Hold Harmless, I grant and pledge a security interest in all money and proceeds arising from any claim therefore, that includes damages due to Twisted M Farm LLC, including insurance proceeds, trust and guardianships, remainders and proceeds from testate to intestate succession, which I agree not to relinquish or disclaim.
I will comply with the rules of Twisted M Farm LLC and the instructions of its employees concerning my use of horses and property and consent to the immediate termination of my riding privileges and/or any participation of any kind on Twisted M Farm LLC grounds, without refund, if in the opinion of Twisted M Farm LLC or its representatives my conduct, or the conduct of someone or something in my party is such that the risk of personal injury or property damage is of concern.
5. SUPPLEMENT TO STATUTORY LIMITATION OF LIABILITY. I understand that Twisted M Farm LLC’s liability as an equine activity sponsor is limited by Texas State Law and I intend Twisted M Farm LLC’s rights under this Agreement to be in addition to these statutory limitations and not as a replacement for them.
By submitting this form I acknowledge that I have read and understood the foregoing Agreement and have agreed to it voluntarily, intending to be legally bound.
Twisted M Farm LLC Arena Rules
1. Be aware and respectful to other riders and the horses.
2. Announce what you are doing loud and clear when passing other riders. Keep space between you and other riders.
3. Only lunge horses with permission from those riding in the arena.
4. Mount and dismount out of the way of riders.
5. May only ride if you have a reserved ride time and have signed this waiver
6. Clean up after yourself and your horse using the provided bucket and rake on the side of the ring.
7. Follow any posted rules and signs.
8. No loose horses in the arena.
9. SPECTATORS MUST STAY SEATED OUTSIDE OF THE RING WHILE WITHIN EITHER ARENA. NO LOUD OR RAMBUNCTIOUS BEHAVIOR.
10. Be aware of weather conditions and the risks they create.
11. If there is an emergency or accident in the arena, you must dismount your horse immediately.
12. Dogs must be kept on a leash and are not allowed inside of the arena or on the property without supervision.
13. Any jumps, barrels, obstacles, etc., must be provided by the rider, approved by Twisted M Farm LLC staff, and removed at the end of the arena usage session.
14. Please leave gates as you find them (if they are closed, please close them)
15. All users must provide a current (within 1 year of date of use) Coggins prior to arrival on property. Coggins may be emailed to twistedmfarm1@gmail.com.
The management and their representatives reserve the right to ask, without refund, for any participant to leave for any inappropriate riding, violation of these rules or other behavior deemed unsafe or unsuitable.
Twisted M Farm LLC Arena Rental Cancellation Policy
This policy serves as Twisted M Farm LLC’s (Twisted M Farm LLC) cancellation standard for individuals who have reserved the use of the covered arena. Advanced notice of cancellation, in compliance with the standards below, is vital to Twisted M Farm LLC being able to provide access to year-round riding facilities to those who otherwise don't have access to these limited resources.
Attendance and Cancellation Standards and Expectations:
Those who reserve arena(s) should plan on utilizing the facilities within the bounds of the date and time for which reservations were made.
Twisted M Farm LLC understands that untimely conflicts and emergencies arise and that those conflicts or emergencies may cause a renter to miss their reserved rental time. However, if a renter is unable to attend their scheduled reservation, the renter is required to provide Twisted M Farm LLC notice of cancellation to be eligible for a refund. A renter must contact Twisted M Farm LLC directly, in person or by phone to cancel reservations.
Cancellations made before the date of the scheduled reservation will receive a full refund.
Cancellations or "no-shows" on the day of a scheduled reservation are not eligible for a refund.
In rare circumstances, Twisted M Farm LLC may need to cancel a previously scheduled reservation for reasons including, but not limited to, extreme weather, unexpected arena conditions, and/or property damage. In these instances, Twisted M Farm LLC is committed to providing as much notice as possible, and all attendees will receive a full refund.
Twisted M Farm LLC Minor Participation Agreement
If the participant is a minor (under 18 years of age), the participant’s parent or guardian must read and agree to the following:
If the participant is a minor, I, the undersigned parent or guardian, am signing this Release of Liability and Hold Harmless Agreement, Twisted M Farm LLC Arena Rules, and Twisted M Farm LLC Barn Rules individually and on behalf of the participant and my marital community (unless single). I verify that I am the parent and guardian of the minor participant and I have authority to enter into the agreements mentioned above. I agree to indemnify and hold harmless Twisted M Farm LLC, its owners, managers, agents, officers, employees, contractors, veterinarians, farriers, and successors of the foregoing, to the fullest extent allowed by law, from any claim, suit, expense of which arises out of the minor’s participation and presence with Twisted M Farm LLC and any activities conducted hereon. I accept full responsibility for all medical expenses incurred due to any activity hereon. I agree that this acknowledgment of risk, release, hold harmless, waiver, and pledge shall apply to all claims, suits, expenses, or Twisted M Farm LLC that arise out of the minor’s participation in any other activities of any kind nature whatsoever having to do with Twisted M Farm LLC.
